Doug is Released

Doug won at VCAT on 2 July 2013 and was returned home later that day. The VCAT member preferred the evidence of experienced veterinarian Dr. Jack Ayerbe and dog judge David Lowe to that of the two Mooney Valley local laws officers. VCAT found that Doug’s length, height, head, eyes, neck, feet, forequarters, hindquarters, loin and coat did not comply with the Standard, applying the Dudas Supreme Court test of substantial or high compliance with the Standard. Doug and his owner were represented by Panel counsel Richard Kendall QC and Andrew Felkel and Panel law firm Michael Faltermaier Lawyers as instructing solicitors. Doug was seized in April 2012. He and his owner lost at the first hearing at VCAT in July 2012. The Panel then intervened to conduct the appeal. The Dudas Supreme Court decision was handed down in November 2012. The appeal then succeeded by consent of the parties and the matter was remitted to VCAT for rehearing. Doug was an immature dog when seized and after 15 months incarceration at the pound is now a substantially mature dog.
