  1. Dear Sir/Madam,

    I am seeking legal representation in relation to a prosecution brought against me by Hepburn Shire Council under the Domestic Animals Act 1994.

    My matter is listed at Kyneton Magistrates’ Court at 9:30 am on 12 October 2026. I have now received the issued charge sheet and summons, summary of facts, informant statement and preliminary brief of evidence.

    The matter concerns alleged dog attacks and several of my dogs have been seized and remain in Council custody. The outcome of the prosecution is extremely important to me because it may affect whether my dogs are returned and whether any forfeiture or destruction orders are sought.

    There are a number of issues within the evidence that I would like properly assessed, including the identification of the individual dogs allegedly involved, the evidence relating to separate incidents, the circumstances surrounding the seizures, and other factual matters contained within the prosecution brief. I also have statements and other material that may be relevant to my defence.

    I have contacted another firm and was quoted $4,400 per court date, including preparation. I simply cannot afford representation at that rate. I have also been advised that I am unlikely to qualify for Victoria Legal Aid because imprisonment is not a likely sentencing outcome.

    I am therefore trying to find a solicitor with experience in Magistrates’ Court prosecutions, particularly Domestic Animals Act or council regulatory matters, who may be willing to consider my case on a reduced fee, fixed fee, payment plan, staged basis, or potentially pro bono if appropriate.

    My priority is not simply avoiding a fine. I am extremely concerned about the future of my dogs and want the evidence and available legal options thoroughly considered before I make any decisions about how to proceed.

    I can immediately provide the complete prosecution brief, charge sheet and summons, correspondence from Council and its solicitors, witness statements and the other material I have collected.

  4. Hi we are is desperate need of help. Our two German Shepherds injured/killed about 8 sheep on someone’s property. The Macedone Shire Council in Victoria have seized our girls and advised that they won’t be allowed back to us until the investigation is over which may take in excess of 60-90 days and the coat being $46.35 per dog per day. Otherwise they said we cam surrender them to.which they will be destroyed. Please help us

  11. Can u please help. My Smithfield male dog was seized by the local laws officers on Wednesday 2nd Feb 2022. They have provided no evidence of an ‘alleged’ dog attack. They have had my dog for a week now and are not communicating anything other than to say he has committed a criminal offence and will go to court. I am completely distraught. I need some legal help. Thank you.

  14. I really need your help! Angel was seized November 23rd 2020 and has been declared a restricted breed dog. I am having this decision reviewed by vcat. I don’t believe Angel even fits the standard but according to an animal attendant with no experience assessing to standard and an animal control officer for local council with no prior experience Angel meets the standard. Before Angel was declared I had emailed the council numerous times regarding Angels parents being AMSTAFF and having vetinary certificates which exempt them from being assessed against the standard! I cannot afford legal representation and the council will be seeking to destroy Angel as they have since alleged that she was involved in a dog attack against another dog. Angel is innocent t of this attack and the witness statements describe a different dog and im confident when that goes to court she will be proven innocent. But as for the restricted breed declaration im finding it hard to find someone with experience to assess her against the standard at the rspca

  15. Dear well-meaning, It is my practice when considering an organisation to check the ANCN registration status.
    When searching Barristers Animal Welfare Panel apparently In October (2020?) ACNC Assistant Commissioner Anna Longley publicly notified some charities they risked losing their charity registration. Charities are obliged to keep their reporting up to date. So sadly I won’t be donating to BAWP this time.

    You may know this, but, if not may interest you.

    Ecuador 2008 Constitution – first country to codify “Rights of Nature” i.e. ecosystems right to exit and flourish; people authority to petition breaches; Gov. required to remedy violations of Natures Rights.

    Switzerland, 2000 Constitutions included rights of dignity for animal and plants – though implication of this not clear.
